Introduction

One of the most aggressive movie companies that enforces the rights of their adult porno videos is Malibu Media, LLC.  They have become known as the king of the hill when it comes to suing people for illegally downloading and sharing their videos on P2p (peer to peer) file sharing website such as Bittorrent.  This blog will provide some general legal information if you are facing a lawsuit or legal demand letter from Malibu Media or its attorneys, or received a notice of subpoena from your ISP or property management company.  If you are panicking, call us now at (877) 276-5084.  We have experience and we can help.

What is the anatomy of a Bittorent lawsuit?

We uploaded an excellent article on this point to our LinkedIn account.  You can read the article about the general process in a Malibu Media bittorent lawsuit here.

Is Malibu Media tough to deal with?

Yes.  They take their intellectual property (“IP”) rights very serious as do many others (artists, authors, photographers, comics, software publishers, etc.).  They consider illegal downloading, sharing and use of their IP to be akin to “stealing” or “theft” or “piracy.”  They have flat out told me TELL YOUR CLIENTS TO STOP STEALING OUR PRODUCTS.  In the case of Malibu Media, this means sharing their videos so others can view them WITHOUT PAYING FOR THEM.  This really upsets them and they have filed literally thousands of lawsuits in courts across the country in an effort to vindicate their legal rights.  So yes, they can be tough, and the more assets you have, and the more adult pornography movies you have shared without authorization, the greater legal liability you, (and if you are a kid reading this, possible your PARENTS may be held liable for).   I don’t say this to scare you, but it is what it is and having dealt with their counsel I know they are not going to just roll over.
